Subject Lands: A location map is not provided with this notice, as this Zoning By-law Amendment applies to all lands within the limits of the Municipality of Lakeshore
Purpose: The purpose of the amendment is to make the following changes to Lakeshore Zoning By-law 2-2012:
- Permit air conditioning units and heat pumps in the interior side yard on a lot, subject to required interior side yard setbacks
- Remove reference to “free-standing” air conditioning units and heat pumps
- Require air conditioning units, heat pumps, and small-scale generating systems to be located no closer to municipal drains than the setback requirements that apply to buildings and structures
- Continue to permit small-scale generating systems to encroach 2.5 metres into a required rear yard and interior side yard, but require a minimum 1.2 metre setback from rear and interior side lot lines
- Introduce a penalty section as it relates to zoning by-law contraventions and enforcement
- To restore the previous Hamlet Commercial Exception 9 (HC-9) zone affecting 2730 County Road 42 which did not permit transport trailers to be used for storage on the property
Council Meeting: Tuesday February 14th, 2023 at 6:00 PM, or as practical thereafter

Take Notice that Council will consider an amendment to Lakeshore Zoning By-law 2-2012, as amended (File: ZBA-03-2023), under Section 34 of the Planning Act, R.S.O.1990, c.P.13.

Any person looking to make a verbal submission must register to speak at Lakeshore.ca/Delegations.
If you wish to be notified of the decision of the Municipality of Lakeshore on the proposed zoning by-law (ZBA-03-2023), you must make a written request to the attention of Ian Search, Community Planning, Municipality of Lakeshore, 419 Notre Dame Street, Belle River, Ontario, N0R 1A0, or email planning@lakeshore.ca.
If A Person Or Public Body would otherwise have an ability to appeal the decision of the Municipality of Lakeshore to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Municipal Clerk of the Municipality of Lakeshore before the proposed Zoning By-law Amendment is passed, the person or public body is not entitled to appeal the decision.
If A Person Or Public Body does not make oral submissions at a public meeting or make written submissions to the Municipal Clerk of the Municipality of Lakeshore before the proposed Zoning By-law Amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
